These Terms of Service (“Terms”) govern your use of the wonder★human website and your purchase of products from us (the “Services”). By visiting the site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping policy, and Returns & exchanges policy.

If you do not agree, do not use the Services.

Who we are

wonder★human is an online store. The store is powered by Shopify. Questions can be sent through our Contact page.

Eligibility

You must be old enough to form a binding contract in your place of residence, or have permission from a parent or guardian who agrees to these Terms. You agree that the information you give us is accurate and that you will keep it current.

Products and made-to-order work

We make pieces after you order them. Descriptions, photos, and size guides are meant to help you choose. Colors can look different from screen to fabric, and handmade or printed details can vary slightly. Those variations are not defects.

We may limit or refuse an order, including if we notice an error, suspected fraud, or a product we cannot make as shown. If we cancel after you have paid, we will refund you.

Orders, prices, and payment

Prices are shown in U.S. dollars unless checkout says otherwise. We may change prices at any time before you place an order. Checkout is the final calculation of price, discounts, taxes, duties (when collected), and shipping.

Payment is processed by Shopify and its payment partners. By placing an order you authorize the charge for the order total. We do not store full payment card numbers on our own systems.

An order is an offer to buy. We accept it when we confirm it and begin fulfilling it. Until then we may decline it.

Shipping and returns

Making time, transit estimates, international duties, and tracking are described in our Shipping policy. Because pieces are made to order, returns and exchanges are limited as described in Returns & exchanges.

Risk of loss passes to you when the carrier has the package, except where applicable law says otherwise. If a package is lost or damaged in transit, contact us and we will help as set out in those policies.

Intellectual property

The wonder★human name, wordmark, site design, product photography, and original artwork are owned by us or our licensors. You may not copy, resell, or use them except to shop with us, unless we give written permission.

You may not use our products or images to manufacture competing goods or to misrepresent an affiliation with us.

Your use of the site

You agree not to misuse the Services, including by attempting to access them in an unauthorized way, interfering with them, scraping them at a scale that harms the store, or using them for any unlawful purpose.

If you send us a message, photo, or other content (for example through Contact), you give us a non-exclusive right to use it to respond to you and to operate the store. Do not send anything you do not have the right to share.

Disclaimer

The Services and products are provided as available. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

Some places do not allow certain disclaimers. In those places, our disclaimers apply only as far as the law allows, and you may have additional rights.

Limitation of liability

To the fullest extent permitted by law, wonder★human and its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services or any product, even if we were told they were possible.

Our total liability for any claim relating to the Services or an order is limited to the amount you paid us for that order.

These limits do not apply to liability that applicable law does not allow us to limit, including (where that law applies) liability for death or personal injury caused by negligence, or for fraud.

Indemnity

You agree to indemnify and hold harmless wonder★human from claims, damages, and reasonable legal fees arising from your misuse of the Services, your violation of these Terms, or your violation of anyone else’s rights, except to the extent we caused the harm.

Governing law

These Terms are governed by the laws of the United States and the state in which we operate our business, without regard to conflict-of-law rules. Courts in that state will have exclusive jurisdiction, except that we may seek injunctive relief in any forum to protect our intellectual property. If you are a consumer, you may also have mandatory rights in your place of residence that this section cannot override.

Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of the Services after a change means you accept the new Terms. For an order already placed, the Terms in effect when you checked out apply to that order, except where the law requires otherwise.
